Terms of Service

Welcome to Splash! These Terms of Service ("Terms") govern your use of the Splash mobile application ("App") operated by Splash Pro IO ("Splash," "we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

Account Creation

  • You must create an account to use most features of the App
  • You may register using your email address, Apple ID, or Google account
  • You must provide accurate and complete information

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access at support@splashpro.io

Account Termination

  • You may delete your account at any time through the App settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your right to use the App ceases immediately

3. Subscriptions and Payments

Free Tier

  • The App offers a free tier with limited features and monthly Spark Credits
  • Free tier includes access to recipe creation, recipe book, and community features

Paid Subscriptions

  • Pro and Expert subscriptions provide additional credits and features
  • Subscriptions are billed monthly or annually through the Apple App Store
  • Prices are displayed in the App and may vary by region

Automatic Renewal

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

  • You may cancel your subscription through your Apple ID account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods

Spark Credits

  • Spark Credits are used to access AI-powered features
  • Credits refresh monthly based on your subscription tier
  • Unused credits do not roll over to the next billing period
  • Credits have no cash value and are non-transferable

4. User Content

Your Content

  • You retain ownership of all recipes, photos, posts, and other content you create ("User Content")
  • By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the App

Content Standards

You agree not to post content that:

  • Infringes any intellectual property rights
  • Is defamatory, obscene, or offensive
  • Contains malware or harmful code
  • Violates any applicable law or regulation
  • Impersonates another person or entity
  • Promotes illegal activities
  • Is spam or commercial advertising

Content Moderation

  • We reserve the right to remove any content that violates these Terms
  • We may suspend or terminate accounts that repeatedly violate content standards
  • We are not obligated to monitor all User Content

5. Intellectual Property

Our Content

  • The App, including its design, features, code, and branding, is owned by Splash Pro IO
  • You may not copy, modify, distribute, or reverse engineer any part of the App
  • "Splash" and the Splash logo are trademarks of Splash Pro IO

Recipe Content

  • Recipes you create are your intellectual property
  • Recipes shared publicly may be saved and used by other users for personal, non-commercial purposes
  • You may not commercially exploit recipes created by other users without their permission

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution

6. AI Features

AI-Generated Content

  • The App uses Google Gemini to provide AI-powered recipe generation and analysis
  • AI-generated recipes are provided "as-is" and should be reviewed before use
  • We do not guarantee the accuracy, safety, or suitability of AI-generated content

Your Responsibility

  • You are responsible for reviewing AI-generated recipes for accuracy
  • Verify ingredients and quantities, especially for dietary restrictions or allergies
  • AI suggestions are for informational purposes and do not constitute professional culinary advice

AI Usage

  • AI features consume Spark Credits based on your subscription tier
  • We may update or modify AI features without notice

7. Community Guidelines

When participating in the Splash community, you agree to:

  • Treat other users with respect
  • Provide honest and helpful feedback
  • Credit original creators when adapting recipes
  • Report inappropriate content or behavior
  • Not engage in harassment, bullying, or discrimination

Violations of community guidelines may result in content removal or account termination.

8. Third-Party Services

Integrations

  • The App integrates with third-party services including Open Food Facts, Instacart, and others
  • Your use of these services is subject to their respective terms and privacy policies
  • We are not responsible for the availability or content of third-party services

App Store

  • The App is distributed through the Apple App Store
  • Your use of the App Store is subject to Apple's terms and conditions
  • Apple is not responsible for the App or its content

9. Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

Food Safety

  • Recipes and cooking suggestions are for informational purposes only
  • We do not guarantee the safety or suitability of any recipe
  • Users with allergies or dietary restrictions should carefully verify ingredients
  • We are not responsible for any adverse reactions or health issues

Service Availability

  • We do not guarantee uninterrupted or error-free operation
  • The App may be temporarily unavailable for maintenance or updates
  • Features may be modified or discontinued without notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Splash Pro IO, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting a notice in the App
  • Updating the "Last Updated" date
  • Sending an email to your registered address (for significant changes)

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Splash Pro IO regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15. Apple-Specific Terms

The following terms apply to your use of the App on Apple devices:

  • These Terms are between you and Splash Pro IO, not Apple Inc.
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties, whether express or implied
  • Apple is not responsible for addressing any claims related to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them against you
